Notar
unabhängiger Träger eines öffentlichen Amtes auf dem Gebiet der vorsorgenden Rechtspflege (§ 1 BNotO); meist freiberuflich Tätiger mit Befähigung zum Richteramt, von der Justizverwaltung öffentlich bestellt zur Vornahme von Akten der ⇡ freiwilligen Gerichtsbarkeit, bes. zur ⇡ öffentlichen Beurkundung, ⇡ öffentlichen Beglaubigung von Unterschriften, Wechselprotesten etc. Der N. erhält für seine Tätigkeit Gebühren nach der ⇡ Kostenordnung und untersteht der Dienstaufsicht des zuständigen Landgerichtspräsidenten. In mehreren Ländern der Bundesrepublik ist N. gleichzeitig ⇡ Rechtsanwalt (Anwaltsnotar), im Gegensatz zum Nur-Notar oder Amtsnotar.
- Die N. sind auch zur Vertretung eines ⇡ Steuerpflichtigen berechtigt (§ 80 V AO).
